Booking Form

1 . BOOKING AND PRICES
Reservation is only registered when the company has received a duly completed and signed request (considered as the rental contract) accompanied by the deposit of 40%. The definitive registration only occurs when the total price of hire has been paid. Should the dates not be respected, then it would be considered as a cancellation of the contract by the hirer.
The balance of the hire is to be paid 6 weeks before the cruise begins.
A bill, which takes the place of the confirmation, will be sent to the hirer after the booking file has been received.
2 . CANCELLATION BY THE RENTER
The period for which the reservation has been concluded can only be altered by agreement with the Company and depending on availability.
The amounts deposited are only reimbursed in the case of cancellation included in the framework of the cancellation insurance (see 3) or if the boat is rebooked. If the lessee cancels the cruise, the following expenses will be retained :
- More than 6 weeks before departure : 100 € administrative costs
- From 4 to 6 weeks before departure : 30% of total rental cost.
- Less than 4 weeks before departure : 100% of the total rental cost.
3. CANCELLATION INSURANCE
Cancellation :
Reimbursement of withdrawal costs provided in our general conditions, in the event of cancellation of your rental for the following reasons :
- Serious illness, serious accident or death of yourself, your spouse, guardian, ascendants, descendants, brothers, sisters, brothers-inlaw, sisters-in-law, sons-in-law, daughters-in-law, fathers-in-law or mothers-in-law.
Relapses, aggravation of a previously existing illness as well as pregnancy complications are guaranteed.
- Important material damage involving your main or secondary residence and obligatorily requiring your presence.
The main exclusions are as follows :
- Mental illness not requiring a hospital stay of more than 7 days,
- Intentional acts,
- Epidemics, natural catastrophes,
- Accidents resulting from amateur mechanical and aerial sporting activities,
- Pregnancy, abortion, childbirth and its normal course,
- Illness not considered at the time of booking,
- Acts of terrorism,
- Drug addiction and alcoholism plus their consequences,
- Accidents resulting from the practice of any professional sporting activities.
We would remind you that you must inform us of your cancellation on the same day as you hear of your difficulties so as to limit the amount of the costs invoiced. In any event, the amount of the cancellation plan complement, increased by the administrative costs (100 €) is never reimbursed. The Company alone will be competent to appreciate if the type of event described comes within the cancellation plan.
4. CANCELLATION BY THE COMPANY
In case the company should not put the boat at disposal on the provided date, as a result of a damage occured during the previous hire or of any difficulty for reasons beyond its control, it would be entitled either to put a boat with equivalent or larger dimensions and the same number of beds at the hirer’s disposal or to refund him the amount he paid without being entitled to aspire to damages.
This refund will be proportional to the number of days corresponding to the loss of use.
5. BOAT’S INSURANCE POLICY AND EXCESS
The company declares that it has subscribed to a comprehensive insurance covering the hirer against :
- The damage he would cause on the boat’s body, accessories and dependencies, the total or partial theft and the engine.
- The corporal and material damages caused by third parties (civil responsability).
The payment of the insurance policy is included in the hire price.
The insurance policy does not cover the persons transported on the boat against the accidents they could suffer. The hirer is his own insurer to the limit of the excess amount (amount in the price list), it is possible to buy back this amount for a fixed price (look at the price list).
The company takes no responsibility for the loss or damage of hirer’s
personal goods likely to affect the hirer and his guests.
6. BOAT UNDERTAKING
The company reserves the right: to change the starting or arriving point, to reverse the cruise’s direction for a single trip, to turn a return journey trip
into a one-way trip or vice versa, provided that these changes do not lead to a change of cruising region (Bourgogne, Alsace...).
All these modifications cannot be the cause of cancellation. The company
is committing itself to refund extra charge paid in the case of special arrangements for the cruise except if the cruise’s direction for a single trip is to be reversed.
The inland navigation is subject to restraints beyond the company’s control : bank or lock restoration, canal dragging, period of unemployment, strike of the lock keepers, flooding, drought... The company reserves the right to limit the navigation areas in case of interruption of the cruise beyond its control.

In any case, the boat undertaking by the hirer occurs when the balance and the guarantee have been paid and the stocklist signed. The company
has to deliver a sea-worthy boat to the hirer, fit out and assured according to the laws and regulations enacted by the proper authorities for the navigation’s class concerned.
The description of the boat and its equipment appears on a stocklist which must be delivered to the hirer. By signing the undertaking, the hirer acknowledges that the boat is in good working and clean order, with the
exception of latent defects.
If the boat provided is not in a sound condition to navigate, either through
lack of an essential safety element, or because it is not in compliance with rulings, and if the Company is not able to offer a boat with the same or better characteristics, the lessee can break off the present contract and obtain refund of the amounts paid without being able to claim damages.
7. USING OF THE BOAT AND RESPONSABILITIES
The hirer is committing himself to use the boat in good faith conforming to the regulations of the Navigation Services, the police squads in France or
the visited countries. Minors are not allowed to steer the boat. The hirer will get the information and initiation needed for the steering of the boat when he takes it. The hirer will be given a document in conformity with the directives of the Ministry of Transport testifying to his ability to steer.
The company reserves the right to refuse the taking of the boat if it appears that the person in charge on board is not competent enough, in spite of references, certificates and licences he would produce, or for any other reason. In this case, the hirer will have his contract cancelled and the amounts he paid refunded, the file charges being deducted, without being entitled to aspire to damages.
The hirer is committing himself to take on board only the authorised number of persons. He is committing himself to use the boat exclusively for sailing, to the exclusion of any trade, professional fishing, transportation activities or else.
The hirer expressly exempts the company from any responsibility in its capacity as ship owner or else, in case he should break these bannings, and he would be the only one to answer for the proceedings, fines and confiscations he would incur towards the Navigation Services, even in case of unwitting fault on his behalf. The towing of a boat, sailing after nightfall or on the sea, subletting and lending are strictly forbidden.
8. DAMAGE AND ACCIDENTS
In case of damage or accidents, the hirer has to inform the company with
urgency and ask for instructions.
A breakdown and aid service is provided by the company which tries hard to quickly intervene during the normal working hours according to the availability of employees and equipment. If the damage is the result of a careless mistake by the hirer, the company is entitled to ask him for compensation.
The loss of use resulting from the damage occured during the hire will not be subjected to any repayment -even partly- of this hire, whatever the cause of the damage may be, except if these are not attributable to the hirer. Even in this case, a 24-hour excess will be deducted.
9. BOAT AND GUARANTEE RETURNING
The hirer has to come back to the arriving point within the time agreed on booking ; except in case of a later amicable agreement being signed and
confirmed in writing. As soon as he is back, the hirer has to indicate his presence to the company and to make an appointment for the stocktaking and the inspection of the boat, which has first to be emptied of his luggage and occupiers. The cleaning and stocktaking of the boat are an integral part of the hire period agreed in the contract.
Each day of delay entitles the company to ask for a compensation equivalent to twice the daily price for the hire, whatever the cause of the delay may be. Bad weather cannot be put forward as a good reason for the delay. The person in charge has to take steps in due time to have this eventuality guarded against. Should the hirer for any reason not be able to take the boat back to the designated port on his own, he would have to ensure its guarding at his own costs and risk, after informing the company. The hiring will only come to an end when the boat has been returned to the company in the conditions mentioned above.
The hirer has to return the boat and its equipment in a good working and clean order. If the return order is satisfactory, the garantee is refunded to the hirer. If the boat is not returned in a perfectly clean state, cleaning costs will be the responsibility of the lessee according to a flat rate depending on the state of the boat (see prices).
Should the damage or the loss of the boat or of any accessory on the stocklist be noticed, the hirer would have to pay its repairing or identical replacement. In this case, a deduction from the guarantee would be made. If the damage or the loss is the result of an accident covered by the insurance policy, the repayment of the guarantee would be delayed until the insurance company pay the bill for the repairs.
The repayment will be deducted from the agreed guarantee and any accidental expenses the accident could have caused (telegram, telephone, travelling, reports, guarding...).
